Terms of Use
The terms that govern your use of the PACHEEZ website and online store, prepared with reference to Australian law.

1. Introduction and acceptance
Welcome to PACHEEZ ("we", "us", "our" or "PACHEEZ"). These Terms of Use ("Terms") govern your access to and use of the PACHEEZ website, online store and any related services (collectively, the "Service") operated by PACHEEZ, an Australian owned and operated business.
By accessing, browsing or purchasing from this website you accept these Terms and agree to be bound by them. If you do not agree to these Terms, please do not use the Service. These Terms apply to all visitors and customers.
PACHEEZ may provide products that are complementary wellness products. Nothing on this Service constitutes medical advice.
2. Definitions
"Products" means the wellness patches and related goods offered for sale on the Service.
"Order" means a request by you to purchase Products submitted through the Service.
"Australian Consumer Law" means Schedule 2 of the Competition and Consumer Act 2010 (Cth), as amended from time to time.
3. Use of the website
You may use the Service only for lawful purposes and in a manner that does not infringe the rights of, or restrict the use and enjoyment of, the Service by any third party.
You must not misuse the Service, including by introducing viruses, attempting to gain unauthorised access, interfering with security features, scraping or harvesting content, or using automated systems to place orders without our consent.
We may suspend or restrict access to the Service at any time without notice if we consider that you have breached these Terms or that your use of the Service is otherwise unlawful or harmful.
4. Accounts and registration
To place an Order you may be required to provide accurate, current and complete information, including your name, email address, delivery address and payment details.
You are responsible for keeping your account credentials and payment information confidential and for all activity that occurs under your account. You agree to notify us promptly of any unauthorised use.
PACHEEZ reserves the right to refuse or cancel an Order or account at its discretion.
5. Orders and acceptance
An Order placed through the Service is an offer to purchase Products. No Order is accepted, and no contract is formed, until PACHEEZ accepts your Order (typically by confirming dispatch or by processing payment).
We may decline to accept an Order, or cancel an accepted Order, where a Product is unavailable, an error in pricing or description has occurred, or for any other lawful reason. Where payment has been taken for a cancelled Order, we will provide a full refund.
You may cancel an Order before it has been dispatched by contacting us using the details below. Once Products have been dispatched, our returns policy set out in these Terms applies.
6. Pricing and payment
All prices are shown in Australian dollars (AUD) and include GST where applicable. Prices are current at the time of display but are subject to change. The price payable is the price displayed at the time your Order is confirmed.
We reserve the right to correct errors in pricing or Product information. If an error is identified after you submit an Order, we will notify you and offer the option to proceed at the correct price or cancel for a full refund.
Payment is processed at the time of order through our secure payment gateway. We accept the payment methods displayed at checkout.
7. Delivery
We will make reasonable efforts to deliver Products within the estimated timeframes published on the Service. Delivery times are estimates only and are not guaranteed.
Risk in the Products passes to you on delivery to the nominated address. You should check deliveries promptly and contact us within a reasonable time if a Product is missing, damaged or incorrect.
If you are not present to take delivery, the carrier may leave the Products at the delivery address or return them for later redelivery. PACHEEZ is not liable for Products left at an unattended address.
8. Returns, refunds and your consumer rights
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a remedy where a Product is faulty, not of acceptable quality, not as described, or does not do what it is supposed to do. Where a failure is major, you may be entitled to a refund or replacement.
Nothing in these Terms excludes, restricts or modifies any non-excludable rights you may have under the Australian Consumer Law or other applicable laws.
For change of mind, PACHEEZ offers returns at our discretion where Products are returned unused, in original packaging and within 30 days of delivery, provided in each case that the Products are in resalable condition. Change-of-mind returns do not affect your statutory rights.
To request a return or refund, please contact us using the details in section 18. We will assess your request and advise the appropriate remedy, which may include a refund, replacement or repair.
9. Warranties and limitation of liability
PACHEEZ provides the Service on an "as is" basis. To the extent permitted by law, PACHEEZ excludes all other warranties, representations and conditions relating to the Service that are not contained in these Terms.
To the extent permitted by law, PACHEEZ is not liable for any indirect, incidental, special or consequential loss or damage, or for any loss of revenue, profit, data or business opportunity, arising out of or in connection with these Terms or the Service.
Where a non-excludable right under the Australian Consumer Law is breached and PACHEEZ is permitted to limit its liability, PACHEEZ's liability is limited, at its option, to the replacement or repair of the Products, the supply of equivalent Products, or the payment of the cost of replacing the Products or of acquiring equivalent Products.
PACHEEZ is not a medical provider. Products are complementary wellness products and are not intended to diagnose, treat, cure or prevent any disease. You should seek independent advice from a qualified health professional before using any Product.
10. Intellectual property
All content on the Service, including text, graphics, logos, images, the PACHEEZ brand and software, is owned by or licensed to PACHEEZ and is protected by Australian and international intellectual property laws.
You may view and use the Service for your personal, non-commercial use. You must not copy, reproduce, modify, distribute or otherwise exploit any content from the Service without our prior written consent.
11. User content
If you submit reviews, comments or other content to the Service, you grant PACHEEZ a non-exclusive, royalty-free licence to use, reproduce and display that content in connection with the Service. You confirm that your content does not infringe any third-party rights and is lawful.
12. Links to third-party websites
The Service may contain links to third-party websites that are not operated by PACHEEZ. We have no control over and accept no responsibility for the content or practices of those websites. Accessing any third-party website is at your own risk.
13. Privacy
Your use of the Service is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information. Our handling of personal information is governed by the Privacy Act 1988 (Cth) and the Australian Privacy Principles.
14. Indemnity
You agree to indemnify and hold PACHEEZ harmless from any claim, loss, damage or expense (including legal costs) arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
15. Changes to these Terms
PACHEEZ may update these Terms from time to time. Updated Terms take effect when published on the Service. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
16. Governing law and jurisdiction
These Terms are governed by the laws of the state or territory in which PACHEEZ is registered in Australia, and the parties submit to the non-exclusive jurisdiction of the courts of that state or territory.
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.
17. Complaints and dispute resolution
If you have a complaint about the Service or Products, please contact us using the details below. We will endeavour to resolve complaints promptly and in good faith.
Where we cannot resolve a dispute, a complaint may be lodged with the relevant Australian consumer protection agency or, for online disputes, with an external dispute resolution body. Nothing in these Terms prevents you from exercising rights you may have under the Australian Consumer Law.
